SUBSCRIPTION TERMS AND CONDITIONS

Conditions of music tuition

 

​1. Lessons

Lessons will be provided on a weekly basis as part of a subscription consisting of no more than 48 in person lessons  per year. Subscription periods will not necessarily coincide with school terms. Lessons will be conducted at 7a Charles Street, Worcester, WR1 2AQ, at the time arranged by prior agreement with the pupil (or the Pupil’s parent or carer) and the Drum School will reserve this time slot for the Pupil.

2. Payment of fees

The Pupil (or the Pupil’s parent or carer) will pay the subscription fee each month falling on the same date as that of their first payment, prior to the first lesson of each subscription period. Each payment will cover up to five lessons per period, up to a maximum of 48 lessons per year.

3. Lesson timetable

Before the first lesson of each subscription period, the Drum School will give the Pupil (or the Pupil’s parent or carer) written confirmation of (i) the dates and times of all lessons in that subscription period (ii) the start date of the following subscription period. Holiday breaks (as specified by the Drum School) may occur partway through a subscription period. Lessons will take place on public holidays only by prior agreement between the Teacher and the Pupil (or the Pupil’s parent or carer).

 

4. Missed lessons

The Teacher will charge for any scheduled lessons which the Pupil does not attend, unless the Teacher chooses not to do so because of exceptional circumstances. If the Teacher cancels a scheduled lesson, the Pupil (or the Pupil’s parent or carer) may choose between (i) carrying the lesson forward; (ii) receiving a replacement lesson; or (iii) receiving a refund of the lesson fee.

5. Replacement Video Lessons

If a pupil is unable to attend a lesson within a subscription period for any reason a recorded video lesson will be provided if 24 hours notice is given.

6. Personel

Whilst every effort will be made to ensure consistency of teacher for lessons, on occasion it may be necessary to provide an alternative teacher. On such occasions the Drum School will ensure that the substitute teacher is suitable for the job and holds an up to date DBS check. No refunds will be issued in instances where a substitute teacher is provided.

7. Holidays

The drum school will be closed for four weeks of the year for one week at Easter, two weeks in the Summer and ten days for Christmas. Holiday periods will be confirmed in writing at least two months before their commencement. Subscription payments must be maintained for these periods.

8. Examinations, competitions and public performances

The Pupil will not be entered for any examination, competition or public performance without the prior consent of both the drum school and the Pupil (and the Pupil’s parent or carer, where appropriate).

9. Examination Waiver

Entry for examination does not guarantee a pass. All efforts will be made to ensure a student is ready for examination before entry but responsibility for the final result does not fall exclusively on the teacher.

 

10. Termination of tuition

a) This Agreement may be ended by mutual consent at any time by both signatories to it signing and dating a written     statement to that effect.

b) Where fees are not paid on time, the drum school reserves the right, entirely at the drum school's discretion, to terminate this Agreement with immediate effect by giving written notice of termination to the Pupil or Pupil’s parent or carer. This right to terminate is without prejudice to any other rights the Drum School may have.

c) Either signatory to this Agreement may terminate the Agreement by giving one month’s notice in writing to the other signatory. Such termination will take effect at the end of a subscription period only and not at any other time. From the period of notice the Drum School will guarantee four lessons for the final subscription period and confirm the date of the final lesson in writing. If the Drum School gives notice to terminate tuition at the end of a subscription period in accordance with this Condition 10(c) the Drum School will continue to provide lessons until the end of that subscription period.

 

11. Failure to give notice

Unless terminated under Condition 10 above, this Agreement shall continue from subscription period to subscription period. If the Pupil (or the Pupil’s parent or carer) fails to give full notice to terminate this Agreement in accordance with Condition 10(c) above and the signatories have not agreed to terminate the Agreement in accordance with Condition 10(a) above, the following charges will be made in lieu of notice:

 

Where the notice given is less than one month before the start of the next subscription period: 100% of the fees for the next subscription period.

 

If the Pupil stops attending lessons while a subscription period is ongoing, the Pupil (or the Pupil’s parent or carer) is not entitled to a refund of any fees paid for that subscription period. The Pupil is entitled to attend any lessons paid for.

 

If the Drum School stops lessons without giving the correct notice specified in Condition 10(c) above the Drum School shall refund any fees already paid for any lessons not given.

 

​12. Conduct

If the Drum School, in their reasonable opinion, feels unable to continue tuition on account of unreasonable conduct by the Pupil or anyone connected with the Pupil, the fees for any outstanding lessons will not be refundable.

 

​13. Changes

Any changes to the terms of this Agreement must be confirmed in writing and signed and dated by both the Drum School and the Pupil (or the Pupil’s parent or carer).

If the Drum School chooses to waive any right or remedy under this Agreement or otherwise (for example, if the Drum School chooses to waive fees for any lessons which the Pupil does not attend) this shall not mean that they must do so in future or that they waive any other rights or remedies, unless agreed in writing in accordance with Condition 10(a) above.

 

14. Communication between the parties

For the purposes of this Agreement written notice must be given on paper or by email.

 

15. Governing law and jurisdiction

This Agreement shall be subject to the laws of the jurisdiction of the location for the lessons (specified above) and the signatories to this Agreement agree that any dispute relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
